प्रतिनिधी / प्रवीण वाघमोडे :मराठा आरक्षणा संदर्भात राज्य सरकारला मोठा सर्वोच्च न्यायालयाने मोठा धक्का दिला आहे. मराठा आरक्षणाबाबत शिंदे-फडणवीस सरकारने सर्वोच्च न्यायालयात पुर्नविचार याचिका दाखल केली होती. सर्वोच्च न्यायालायाने ही याचिका फेटाळल्याची माहिती समोर आली आहे.मराठा समाजाला आरक्षण देण्यात यावं, अशी याचिका शिंदे-फडणवीस सरकारकडून सर्वोच्च न्यायालयात दाखल करण्यात आली होती. सर्वोच्च न्यायालयाने फेटाळल्याने मराठा आरक्षण मिळण्याची शक्यता आता मालवली आहे. यावर याचिकाकर्ते विनोद पाटील यांना कडाडून संताप व्यक्त केला आहे.
पाटील म्हणाले, आत्तापर्यंत समाजाने 4 मुख्यमंत्री पाहिलेत पृथ्वीराज चव्हाण मुख्यमंत्री असताना आरक्षण मिळालं. देवेंद्र फडणवीस आणि उद्धव ठाकरे याचं सरकार पाहिलं. त्यानंतर आता एकनाथ शिंदे मुख्यमंत्री असतानाचं सरकार पाहत आहे. पण कुठल्याही सरकारने मराठा आरक्षणाबाबत गांभीर्याने घेतलं नाही, हे अंतिम सत्य असल्याचं ते म्हणाले आहेत.आता फक्त शेवटचा पर्याय उरलायं, राज्य सरकारने आत्तपर्यंत हा विषय गांभीर्याने घ्यावा, मराठा समाजाच्या तरुण पिढीचं म्हणणं असल्याचं ते म्हणाले आहेत. दरम्यान, सर्वोच्च न्यायालयाच्या न्यायमूर्तींनी चेंबरमध्येच चर्चा केल्यानंतरच याचिका फेटाळली आहे.

सर्वोच्च न्यायालयाने मराठा आरक्षणासंबंधी पुर्नविचार याचिका फेटाळण्याचा निर्णय मराठा समाजासाठी दुर्देवी असल्याची प्रतिक्रिया माजी मुख्यमंत्री अशोक चव्हाण यांनी दिली आहे. दरम्यान, मराठा समाजाला आरक्षण मिळण्याबाबतची पुर्नविचार याचिका राज्य सरकारकडून दाखल करण्यात आली होती. ही याचिका सर्वोच्च न्यायालयाने फेटाळलीय.
चव्हाण म्हणाले, राज्यांना आरक्षण देण्याचा अधिकार नसणे आणि ५० टक्के आरक्षण मर्यादा, या दोन अडथळ्यांमुळे सर्वोच्च न्यायालयाने ५ मे २०२१ रोजी मराठा समाजाला आरक्षण देणारा एसईबीसी कायदा रद्दबातल केला होता.त्यानंतर १० व ११ ऑगस्ट २०२१ रोजी केंद्र सरकारने संसदेत १२७ वे घटना दुरुस्ती विधेयक मांडून जातीसमूहाचे मागासलेपण निश्चित करण्याचे अधिकार राज्यांना बहाल केले. त्यामुळे पहिली अडचण दूर झाली.मात्र, त्याचवेळी ५० टक्के आरक्षण मर्यादा शिथिल करण्याचा निर्णय केंद्र सरकारने घेतला असता किंवा ही आरक्षण मर्यादा पार करणाऱ्या आर्थिक दुर्बल घटकांच्या आरक्षणाप्रमाणेच मराठा आरक्षणाला संसदेतून आवश्यक ते घटनात्मक तरतुदीचे संरक्षण दिले असते तर कदाचित आज मराठा समाजाला न्याय मिळाला असता, असंही त्यांनी स्पष्ट केलंय.
दरम्यान, त्यावेळी महाविकास आघाडीच्या खासदारांनी ५० टक्के आरक्षण मर्यादा शिथिल करण्याची मागणी संसदेत आक्रमकपणे मांडली. मात्र, भाजपने त्याबाबत अक्षम्य मौन बाळगले. त्याचीच परिणीती सर्वोच्च न्यायालयाच्या आजच्या निकालात दिसत असल्याचं चव्हाण म्हणाले आहेत. मराठा समाजाला आरक्षण द्यायचे असेल तर ५० टक्के आरक्षण मर्यादा शिथिल करणे महत्त्वपूर्ण आहे. किमान यानंतर तरी राज्य सरकार व भाजप ५० टक्के आरक्षण मर्यादा शिथिल करण्यासाठी केंद्र सरकारकडे पाठपुरावा करणार अशी अपेक्षा असल्याचं ते म्हणाले आहेत.
